Terms of service
The terms that apply when you use this website or buy services from Duddon Digital, in plain English. Last updated 25 October 2026.
1. Who we are
Duddon Digital is the trading name of the company registered in England and Wales under company number 17173485, registered office 66 Paul Street, London EC2A 4NA (“we”, “us”, “our”). You can contact us at kieron@duddondigital.co.uk or 07337 819479.
“You” means the person or organisation using this website or buying services from us.
2. About these terms
- These terms apply to every job we do unless we agree otherwise in writing. By accepting a quote, paying an invoice or asking us to start work, you accept them.
- A written quote, proposal or agreement for a specific job takes priority over these terms where the two differ. For larger or public-sector work, we may use a separate contract, or work on your own terms if we agree to.
- Prices and descriptions on this website are an invitation to get in touch, not a binding offer. A contract is formed when we confirm a job in writing (email is fine) or start work at your request.
- If you are buying for a business or organisation, you confirm you have authority to agree to these terms on its behalf.
3. Our services
- Websites – design and build of websites for small businesses and organisations, plus later updates.
- Research and tender support – evidence reviews, data analysis, reports and practical digital support around tenders, mainly for public and third-sector clients.
- Game servers – setup, configuration, mods, Discord builds, add-ons and monthly management for community game servers.
We carry out all work with reasonable care and skill, as you would expect from a competent professional.
4. Quotes, scope and changes
- We agree what is included (the scope) and the price in writing before work starts. A quote is valid for 30 days unless it says otherwise.
- Anything not in the agreed scope is extra. If you ask for changes or additions, we will tell you whether they affect the price or timescale and get your agreement before doing them.
- Timescales are estimates made in good faith. They depend on you providing content, feedback and access on time (see section 10).
5. Prices and payment
- Prices are in pounds sterling. We will make clear on the quote or invoice whether VAT applies.
- We invoice for our work. Card payments are processed securely by Stripe through a payment link on the invoice. For some work we may accept bank transfer (BACS); our bank details will only ever be given on the invoice itself. If you receive a message asking you to pay into different bank details, please call us on 07337 819479 to check before paying.
- Unless the quote says otherwise, invoices are due within 14 days. For larger website or research projects we may ask for a deposit before starting, with the balance on completion or in stages, as set out in the quote.
- Game server setup and one-off add-ons are paid before work starts. Monthly management is paid monthly in advance.
- If an invoice is overdue we may pause work until it is paid. For business clients, we may also claim interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998.
- Our published game server prices cover our work only. Third-party costs such as hosting, domains, paid mods, plugins, themes or software are paid by you directly to the provider unless we agree otherwise.
6. Websites
- Demo first. We may prepare a demo homepage so you can see the direction before committing. A demo is free and without obligation unless we agree otherwise; until you commit, the demo design and wording remain ours.
- Fixed quote. After the demo and a scoping conversation, we give you one fixed price for the agreed scope.
- Your domain and hosting. Your domain name and hosting are registered in your name and paid for by you, so you stay in control. If we help set them up, we do so as your helper, and we will give you, or help you keep, the login details.
- Content. You are responsible for the accuracy of the content you provide, and for having the right to use it (see section 10). We can suggest wording, but you approve what goes live.
- Sign-off. We will ask you to review the site before launch. Once you approve it, or it goes live at your request, the build is complete. We will fix any bugs in our own work that you report within 30 days of launch at no extra cost.
- Later changes. Updates after launch are quoted up front. We are not responsible for problems caused by changes made by you or other people, or by your hosting provider.
7. Research and tender support
- We check the sources we cite and describe the strength and limits of the evidence. We use AI tools within a defined process, a person checks and signs off every deliverable, and we disclose our use of AI.
- Research reflects the evidence available at the time. You are responsible for decisions you make based on it.
- For tender support, we prepare draft material for your review. Nothing is submitted on your behalf without your approval, and you remain responsible for the final content of any bid. We cannot guarantee that any bid or tender will be successful.
8. Game servers
- Hosting is not included. You rent your server directly from your chosen hosting company and pay them. Our prices cover setup, configuration and management only.
- Your accounts. Paid mods, plugins and scripts are bought in your own account so the licence is yours. You must follow the game’s, the host’s and Discord’s own terms; we may decline work that would break them.
- Access. You give us the access we need (for example, a sub-user or admin login). Please remove it when you no longer need us. We will only use it to do the work you have asked for.
- Setup support. Setup packages include 7 days’ support for issues with our setup, starting when we hand the server over.
- Monthly management is a rolling monthly service. You can cancel at any time; it stops at the end of the month you have already paid for. Plus includes up to 5 hours of changes a month; unused hours do not roll over.
- Support is through your Discord ticket channel and by email, during reasonable working hours. Same-day response on Plus means a reply the same day for tickets raised during the working day.
- No 24/7 service or uptime guarantee. We fix crashes and configuration problems on our side, but we do not provide round-the-clock monitoring, and we are not responsible for outages, data loss or performance problems caused by your hosting company, game updates, third-party mods, Discord, or your players.
- Backups. We set up backups where your host allows it, but your host is responsible for the server and its storage. Keep your own copies of anything important.
- Founding customer discount. Our first 5 game server customers get 20% off in exchange for an honest review, good or bad. The maximum discount is 20%, offers cannot be combined, and we may end the offer once the 5 places have gone.
9. Cancellations and refunds
- You can cancel a job at any time by telling us in writing. You pay for work already done and any costs we have already committed to on your behalf up to that point. Any deposit or prepayment beyond that is refunded.
- Monthly services can be cancelled at any time and stop at the end of the current paid month. We do not refund part-months.
- We may cancel a job by giving you reasonable notice. If we do, you pay only for work completed and we refund anything paid in advance for work not done. We may stop work straight away if you seriously break these terms (for example, non-payment or abusive behaviour).
- If something we delivered is not right, tell us promptly. We will put it right at no extra cost, and if we cannot, we will offer a fair refund for the affected part.
- If you are a consumer (buying for yourself, not a business), you normally have 14 days from the date the contract is made to cancel a contract made online, by email or by phone. If you ask us to start within those 14 days, you will pay for the work done up to the point you cancel, and if the service is completed within the 14 days you lose the right to cancel. This does not affect your other legal rights.
10. Your responsibilities
- Give us accurate information, content, feedback, approvals and access on time. Delays on your side may move timescales and, if work has to be re-done, the price.
- Make sure you own, or have permission to use, anything you give us (text, images, logos, data, mods), and that using it will not break the law or anyone else’s rights.
- Keep your own logins secure and keep your own copies of important content and data.
- Pay invoices on time.
11. Intellectual property
- You keep ownership of everything you give us. You give us permission to use it only to do the job.
- Once you have paid in full, you own the deliverables we create specifically for you (for example, your website design and content, or a research report), and we transfer our rights in them to you. Until then, you may use them for review only.
- Some things are not ours to transfer: third-party items such as open-source code, fonts, stock images, themes, plugins and game mods stay under their own licences, which you must follow. Our general know-how, tools, templates and code we reuse across projects remain ours, and we give you a permanent licence to use them as part of your deliverables.
- Unless you tell us not to, we may mention that we worked for you and show non-confidential parts of the work (for example, a screenshot of a live public website) in our portfolio.
12. Our liability
- Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot legally be limited.
- If you are a business or organisation: we are not liable for indirect or consequential losses, or for loss of profit, revenue, business, contracts, goodwill or data. Our total liability for any job is limited to the amount you have paid us for that job; for monthly services, it is limited to the fees paid in the 12 months before the claim.
- If you are a consumer: we are responsible for losses you suffer that are a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We are not responsible for losses that were not foreseeable, or for business losses. Your legal rights, including under the Consumer Rights Act 2015, are not affected.
- We are not responsible for the acts or failures of third parties outside our control, such as hosting providers, domain registrars, game developers, mod authors, Discord or payment providers.
13. Confidentiality and data
We keep your confidential information private and use it only to do the work, unless you agree otherwise or the law requires disclosure. Where we handle personal data on your behalf as part of a job (for example, data in a research dataset), we do so only on your instructions and will agree any further data protection terms needed. Our privacy notice explains how we handle personal data about you.
14. Events outside our control
We are not responsible for delays or failures caused by events outside our reasonable control, such as hosting or internet outages, third-party service failures, illness, extreme weather or other emergencies. We will let you know as soon as we can and do our best to keep things moving. If the delay goes on for more than 30 days, either of us can cancel the affected work, and you pay only for work done.
15. General
- We may use trusted subcontractors or tools for parts of a job, but we remain responsible for the work.
- Neither of us may transfer the contract to someone else without the other’s agreement, except that we may transfer it as part of a business reorganisation, as long as your rights are not reduced.
- If any part of these terms is found to be unenforceable, the rest still applies.
- If we do not enforce a right straight away, we can still enforce it later.
- Only you and we have rights under the contract; no one else does.
- This website is provided as it is. We try to keep it accurate and available, but we do not guarantee it will always be either.
16. Governing law and disputes
These terms, and any contract between us, are governed by the law of England and Wales. If there is a problem, please tell us first and we will try to sort it out quickly and fairly. If we cannot, the courts of England and Wales will deal with it, except that if you are a consumer living in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
17. Changes to these terms
We may update these terms from time to time. The version on this page when you accept a quote or start a job applies to that job; for monthly services, we will give you at least 30 days’ notice of any significant change, and you can cancel before it takes effect.
